User terms
Give A Second LLC was created with the aim of developing a new revenue stream for charity and an opportunity for people to recognize the efforts of participating businesses. A portion of the listing packages sold to businesses are donated by give a second llc to a 501(c)(3) tax-exempt organization. The chosen charity and charitable percentage is subject to change without prior notice. Any substitutions will always be to charities that are 501(c)(3) tax-exempt organizations.
By using, accessing and/or downloading the information contained on this site, you acknowledge that it is your duty to NOT store, resell, reproduce or otherwise make use of information in a manner that is in violation of any federal, state or local laws or regulations, including any copyright. You are authorized to view, download and print any information on the site, solely for your own personal and noncommercial use, subject to all copyright, trademark and other proprietary notices.

Participating businesses who submit any content, photos or other materials for use by Give A Second LLC on the Site, in emails or social media, you warrant that you are the sole owner of such content and authorized to allow it's use and agree and grant Give A Second LLC perpetual, irrevocable, nonexclusive, transferable, royalty-free, and fully sublicensable license to use, reproduce, copy, adapt, modify, merge, distribute, display, form and create direvetive works from or incorporate said content in other works and use for advertising and promotional purposes.
Give A Second LLC's entire liability and User's and participating businesses exclusive remedy for damages due to performance or non-performance of Give A Second LLC for any cause or service whatsoever, regardless of the form of action, shall be limited to the refund of the charges specifically related to the performance or non-performance of the direction of User or participating business. YOU EXPRESSLY UNDERSTAND AND AGREE THAT GIVE A SECOND LLC WILL NOT BE LIABLE TO YOU fOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF GIVE A SECOND LLC HAS BEEN ADVISED OR AWARE OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: THE USE OR THE INABILITY TO USE THE SITE OR SERVICES; THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED FROM TRANSACTIONS ENTERED INTO THROUGH OR FROM THE GIVEASECOND.COM WEBSITE AND/OR GIVE A SECOND LLC EMAILS, SOCIAL MEDIA, PROMOTIONAL PROGRAMS OR ADVERTISING.

The waiver of any breach or default of these Terms and Conditions shall not be deemed to be a waiver of any other or successive breach or default and shall not act to amend or void the rights of Give A Second LLC .
Give A Second LLC may, in its sole discretion, choose to remove or not to remove reviews submitted to the Site by participating businesses.
Participating businesses will not submit any reviews from customers that may be considered by Give A Second LLC to be infringing, harassing, libelous, obscene, maligning, diparaging, offensive, defamatory, or otherwise violates any relevant law or right of any other party and will be accurate and honest in all respects.
The reviews provided on the Site from participating businesses do not reflect the views of Give A Second LLC, its officers, members,managers, owners, employees or other users.
If a review is for an experience with a health care or wellness provider business, you declare that you have the legal authority to disclose such health information and experience of such individual, if applicable.
All reviews submitted to Give A Second LLC must guarantee that the reviewer does not work for or own interest in the participating businesses for which you submit reviews and they are not in any way related to any of the business owners for which you submit reviews and that they have not received any form of compensation for these reviews.

All Content that you submit is not confidential and may be used at Give A Second LLC's sole discretion. Give A Second LLC may or may not pre-screen Content. However, Give A Second LLC will have the right and not the obligation in their discretion to pre-screen, change, condense or delete any Content on the Site. Give A Second LLC has the right to remove any Content that Give A Second LLC deems, in its sole discretion, to violate these Terms and Conditions. Give A Second LLC does not guarantee that you will have recourse to edit or delete any Content you have submitted. Give A Second LLC reserves the right to incorporate any Content you have submitted for use on the Site, social media and/or promotional materials. Give A Second LLC reserves the right to remove or to refuse to post any submission for violation of any of these terms or guidelines. You acknowledge that you, not Give A Second LLC, are responsible for the contents of any Content you submit. THIS AGREEMENT SHALL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MARYLAND WITHOUT CONSIDERATION OF ITS CONFLICT OF LAW PRINCIPLES AND USERS AND PARTICIPATING BUSINESSES, BY ACCEPTING THIS AGREEMENT, CONSENTS AND AGREES TO EXCLUSIVE JURISDICTION. BOTH GIVE A SECOND LLC AND USERS AND PARTICIPATING BUSINESSES WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY DISPUTE BETWEEN THE PARTIES.
You agree that any proceeding, whether in arbitration or in court, will be conducted only on an individual basis and not in a class, collective, consolidated, or representative action. You agree to waive any right to bring or to participate in such an action in arbitration or in court to the fullest extent permitted by law. To the fullest extent permitted by law, you waive the right to a jury trial.
GIve A Second LLC may terminate or suspend any transaction if the user violates any section of the Terms & Conditions.
